The City Engineer of the City of Pullman shall grant such permit only upon compliance with the following terms and conditions: the party requesting such permit shall make application therefor in writing and file the same with the engineer, giving a brief description of the obstruction or thing desired to be done or constructed and the location upon the street, alley, highway, sidewalk, or public place to be so obstructed, together with an estimate of the area of the street, alley, highway, sidewalk, or public place to be so obstructed. The act or acts permitted under such permit shall at all times be under the supervision and control of the engineer, but at the expense of the party procuring such permit and the place that is obstructed shall be returned to its former condition within the time required by the engineer. At the expiration of the time fixed by such permit or upon the completion of the work allowed to be done by such permit, the engineer shall, if he deems it advisable, have the right to do all work and things necessary to restore such street, alley, highway, sidewalk, or public place to its original and proper condition and to remove all obstruction and the party obtaining such permit shall be liable for the expense thereof; providing that the City shall have, in addition to any other rights hereunder, a cause of action for all expenses and amounts paid out upon the work of removing the obstruction, and restoring the street, sidewalk, highway, or public place to its original condition.
