(1) At such times as the Fire Services Department makes routine or other fire inspections, it shall also inspect all such inspected premises to assure compliance with the requirements for placing and maintaining litter receptacles as required by the provisions of WAC 173-310-040 through WAC 173-310-060 as now existing and in accordance with any amendments that may hereafter be made thereto. In the event violations of this Section 5.45.050 are found, the fire department is authorized to issue citations for a civil infraction. Penalties for violation of this subsection 5.45.050(1) shall be in accordance with the provisions of Section 70.93.090 RCW as now existing and in accordance with any amendments that may hereafter be made thereto.

(2) The Department of Public Works shall not approve occupancy of any building, structure, or other improvement for new construction or modification to any existing building, structure, or other improvement for which a building permit is required, nor give final inspection approval to any such building, structure or other improvement, until litter receptacles as required by the provisions of WAC 173-310-040 through WAC 173-310-060 as now existing and in accordance with any amendments that may hereafter be made thereto have been set in place on the particular property involved.
