(1) The office of hearing examiner exercises all quasi-judicial powers and functions authorized by the city council.

(2) Specifically, the hearing examiner conducts public hearings and renders decisions on:

(a) Appeals from staff decisions and interpretations;

(b) Applications for variances;

(c) Applications for conditional use permits, except when PCC Title 17 provides for planning commission review;

(d) Site plans referred by the Director of Community Development;

(e) Appeals to the Construction Code of the City of Pullman, Chapter 2.10 PCC.

(3) The hearing examiner has such other powers as are necessary to carry out the intent of this chapter, including to conduct pre-hearing conferences, to require the submittal of information, to schedule and continue hearings, to rule on all evidentiary, procedural and other matters, and to prescribe regulations and rules of procedure for the conduct of hearings and other proceedings authorized by this chapter, subject to the approval of the city council.

(4) The hearing examiner may include in a decision any conditions of approval that are necessary to ensure that the proposal complies with all applicable zoning code criteria and comprehensive plan policies and does not adversely affect surrounding property or the area.

(5) The hearing examiner may revoke an approved permit for failure to comply with any such conditions, upon application by city officials. (Ord. 24-01 §1, 2024; Ord. 22-2 §7, 2022).
