(1) Once a complete application for a proposed boundary line adjustment has been filed in accordance with Section 13.95.050, the director of public works shall, within 30 days of the date of filing, either:

(a) Approve the proposal as submitted; or

(b) Approve the proposal subject to conditions; or

(c) Return the proposal to the applicant for modification or revisions; or

(d) Disapprove the proposal.

(2) The director of public works may approve a proposed boundary line adjustment when it can be determined that the proposal conforms to the following criteria:

(a) It would not result in the creation of any additional lot, site, or division;

(b) It would not create any lot, site, or division that contains insufficient area and dimensions to meet the requirements of Title 17 of this code (Zoning Code);

(c) It would not create any lot that would have inadequate storm water drainage, water supply, or sanitary sewage disposal, nor insufficient access for vehicles, utilities, or fire protection;

(d) It would be in conformance with any applicable building, zoning, or similar regulations;

(e) It would not increase the nonconforming aspects of an existing nonconforming lot.

(3) Within seven days of the date of the decision made under Subsection 13.95.060(1), the director of public works shall notify the applicant in writing of said decision. (Ord. 02-10 §2, 2002).
