Penalties – Forfeitures. Any person who regularly removes, transports, or disposes of solid waste from a premises for compensation without having first been issued a solid waste collector license by the city pursuant to the provisions of Section 6.10.030, shall be deemed to have committed a civil infraction pursuant to the provisions of Chapter 1.02 PCC; and for the purpose of determining the amount of a penalty forfeiture the infraction shall be a Class 3 civil infraction as classified in Section 1.02.020 PCC.

For a second infraction occurring within a twelve-month period from the date of the first infraction, the second infraction shall be a Class 2.5 civil infraction as classified in Section 1.02.020 PCC for the purpose of determining the amount of the penalty forfeiture. For a third and subsequent infractions occurring within a twelve-month period from the date of the first infraction, each infraction shall be classified as a Class 1 civil infraction as classified in Section 1.02.020 PCC for the purpose of determining the amount of each penalty forfeiture.
