(1) License required. A person shall not regularly remove, transport, or dispose of solid waste from a premises for compensation, unless prior to doing so that person,

(a) holds a current certificate of convenience and necessity issued by the Washington Utilities and Transportation Commission in accordance with the provisions of Chapter 81.77 RCW as now existing and in accordance with any amendments that may hereafter be made thereto; and,

(b) has obtained a license from the city finance director to operate as a solid waste collector in the city.

(2) Application requirements. The city finance director shall issue a license to a person to operate as a solid waste collector in the city when the applicant

(a) has provided proof to the satisfaction of the city finance director that the applicant is the holder of a current certificate of convenience and necessity to operate within the city issued by the Washington Utilities and Transportation Commission pursuant to the provisions of RCW 81.77.040 as now existing and in accordance with any amendments that may hereafter be made thereto; and,

(b) has filed with the city finance director a copy of its current schedule of rates and tariffs approved by the Washington Utilities and Transportation Commission; and,

(c) has provided proof that the applicant has in effect liability insurance in the amounts required by the Washington Utilities and Transportation Commission with the city of Pullman named as an additional insured thereon, and has provided a certificate from the insurance carrier stating that the insurance will not be canceled without the city having received at least ten calendar days notice prior to such cancellation; and,

(d) has provided written assurances satisfactory to the city attorney that the solid waste collector will indemnify and hold harmless the city of Pullman from any and all liability and damages of any nature whatsoever resulting from injury to persons and property caused by or arising out of the activities of the solid waste collector, its employees, and agents in connection with the performance of its activities carried on pursuant to the license to operate as a solid waste collector in the city of Pullman; and,

(e) has paid to the city the annual license fee for a license to operate as a solid waste collector in the city. (Ord. 90-12 §3, 1990).
