(1) Within ten calendar days after the close of an appeals hearing, the Hearing Examiner shall either:

(a) Affirm the notice, order, or decision of the building official or fire chief; or

(b) Reverse the notice, order, or decision of the building official or fire chief; or

(c) Modify the notice, order, or decision of the building official or fire chief.

(2) Prior to issuing its formal written decision, the Hearing Examiner shall make findings of fact and conclusions representing the official determination and specifying the basis for the decision.

(3) The decision of the Hearing Examiner shall be a final order which shall be effective at the time specified in its decision.

(4) The Hearing Examiner’s determination shall be in conformance with the standards of IBC Section 113.2. (Ord. 24-02 §1, 2024; Ord. 10-8 §2, 2010; Ord. 08-2 §4, 2008; Ord. 86-11 §12, 1986).
