A lender shall not, because of race, color, religion, sex, national origin, age, presence of a mental, physical, or sensory handicap, marital status, sexual preference, or familial status of a borrower or prospective borrower do the following:

(1) Deny to a prospective borrower a loan for the acquisition, construction, repair, or maintenance of a housing accommodation;

(2) Discriminate against a borrower or prospective borrower in the terms, conditions, or privileges of such a loan;

(3) Refuse to negotiate for a sale or rental; make a dwelling unavailable. (Ord. 92-33 §5, 1992; Ord. 81-6 §5, 1981; Ord. B-229 §3, 1975; Ord. B-85 §7, 1973).
