Nothing contained in this Chapter shall require a utility to install its utility facilities underground until it has received, or made arrangements for, the payments of its excess costs as provided by its rate schedules and tariffs filed with the Washington Utilities and Transportation Commission, or promulgated by the Commission.

In the event of conflict between any of the provisions of this Chapter, and rules, regulations, rate schedules, or orders filed with or promulgated by the Washington Utilities and Transportation Commission or other regulatory authority having jurisdiction in the premises, the latter shall prevail, providing the same do not infringe upon the police regulatory powers of the city.
